A Senior Legislative Aide to the Speaker of the Federal House of Representatives and Legislative Consultant, Sadiq Muritala Adewale, has commended the Oyo State House of Assembly for pioneering the Post-Legislative Scrutiny (PLS) framework.
Adewale made this commendation in a statement released to newsmen on Thursday in Abuja.
It was recalled that the Oyo State House of Assembly set an important precedent in Nigeria by becoming the first state legislature to establish a Post-Legislative Scrutiny (PLS) framework.
Adewale said that this move represents a significant step toward enhancing the effectiveness and accountability of legislative processes in Nigeria.
He explained that the framework is designed to ensure that laws passed by the Assembly are not only well-crafted but also effectively implemented, with a clear focus on achieving the intended outcomes.
According to him, “In many democratic systems, legislation is seen as a critical tool for governance, but the process does not end with the passage of a law. The real test lies in the execution and impact of that legislation. This is where Post-Legislative Scrutiny comes in. By monitoring the real-world impact of the laws, assessing whether they are achieving their objectives, and identifying any gaps or shortcomings, the Oyo State House of Assembly is making a bold statement about its commitment to results-oriented governance.
“This framework is vital for ensuring that the laws passed by the legislature are not just symbolic but serve their intended purpose of improving the lives of the citizens they aim to serve. It also holds the executive accountable by providing a structured means for reviewing the progress of policy implementation.”
He further noted that, “Before this time, there was generally no mechanism in place for post-legislative scrutiny in the Nigerian legislative procedure. With the legislative cycle in the Nigerian system ending with the assent of the President or Governor, it raises the question of how we can mandate legislators to ensure that laws made are not abandoned. This would safeguard against prioritizing the quantity of bills passed over quality, ultimately enhancing accountability and good governance.”
Adewale continued, “Over the years, parliaments worldwide have started paying more attention to the implementation of legislation and focusing on post-legislative scrutiny. This concept allows the legislature, through its committees, to scrutinize and evaluate the effects and consequences of a law after it has been passed. It underpins the critical role that legislatures can play in the lives of their citizens by providing a mechanism for those affected to be heard. This can be considered in two broad ways: first, the enactment of the law to ensure its legal provisions are brought into force, and second, the consideration of the impact of legislation to ensure that the legislative intent is met and improvements in delivery can be identified.”
He added, “The embrace of this initiative serves as a model for other state legislatures in Nigeria. In a country where the effectiveness of laws is often undermined by weak enforcement or inadequate follow-up, adopting a Post-Legislative Scrutiny framework can be a game-changer. It strengthens the bond between lawmakers and the people they represent, fostering greater transparency and trust in governance.”
Adewale concluded, “Therefore, it is imperative that other state houses of assembly across Nigeria take a cue from Oyo’s leadership and adopt similar frameworks. By doing so, they will not only improve the quality of legislation but also ensure that laws are more attuned to the needs of the people, ultimately promoting better governance and a stronger democracy.”
